Everytime the topic “bluetooth marketing” comes up, someones always says: “but….isn´t that a kind of Mobile spamming??” First and foremost: NO.
Second, to speak about this subject the first thing to do is define the term “spam”.
Wikipedia says: “unsolicited or undesired electronic messages (named after the Monty Python sketch); in particular:
E-mail spam: unsolicited or undesired email messages
Spam (gaming): the repetition of an in-game action
Street spam or Flyposting: illegal blanket advertising in public places”
So, the answer is clear. As long as the sending of Mobile Content is completely subject to invitation first and permission only practices, with total transparency, and a well identified brand name attached to it, then this kind of action is not considered (and it does not feel like so to the user) spam.
Proximity Marketing, when correctly done, is clean and it is specifically designed to avoid abuse in the form of spamming or in any other form.
